1. Who we are

The Platform is operated by Week Homes S.r.l. (“Now Villa”, “we”, “us” or “our”), a company incorporated in Italy with registered office at Viale San Concordio 367/C, 55100 Lucca (LU), Italy, VAT number and tax code 02298870466.

2. The Now Villa platform and our role

Now Villa is an online marketplace that connects property owners and managers (“Hosts”) who wish to offer short-term accommodation with travellers (“Guests”) who wish to book it. Now Villa also provides ancillary tools such as messaging, itinerary planning and shared-expense features (the “Now Villa Wallet”).

Now Villa acts solely as an intermediary. When a Guest books a listing, a direct contract for the accommodation is formed between the Host and the Guest. Now Villa is not a party to that contract, is not the owner, manager, agent or insurer of any listed property, and does not own, control or manage any accommodation. Hosts are solely responsible for their listings and the accommodation they provide.

We do not guarantee the existence, quality, safety, legality or accuracy of any listing, nor the ability of a Host to host or a Guest to pay.

3. Eligibility and accounts

To use the Platform you must be at least 18 years old and able to enter into legally binding contracts. By registering you confirm that the information you provide is accurate, current and complete, and you undertake to keep it up to date.

You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Notify us immediately at legal@nowvilla.com if you suspect any unauthorised use of your account.

We may refuse, suspend or terminate an account at our discretion where we reasonably believe these Terms or applicable law have been breached, or to protect the Platform, Hosts, Guests or third parties.

4. Bookings and the accommodation contract

A booking is confirmed when the Guest completes the reservation and payment flow and receives a confirmation. At that point a binding contract is formed directly between the Host and the Guest, on the terms of the listing (including price, dates, guest capacity, house rules and the applicable cancellation policy).

Guests agree to read the full listing, house rules and cancellation policy before booking, and to use the accommodation only for the number of guests and the purpose stated in the booking. Hosts agree to honour confirmed bookings and to provide the accommodation as described.

5. Prices, fees and payments

Prices are set by Hosts and displayed inclusive of applicable taxes where required. Guests pay the total shown at checkout, which may include the nightly rate, cleaning and other Host-set charges, and a Now Villa service fee. Any applicable tourist tax may be collected separately as indicated in the listing.

Payments are processed by our payment provider, Stripe, through Stripe Connect. By using the Platform, Hosts and Guests also agree to the applicable Stripe terms. Hosts must complete Stripe onboarding to receive payouts; payouts are released to the Host in accordance with the payout schedule after the relevant check-in, net of Now Villa’s fees.

Hosts pay for use of the Platform through an annual subscription and/or a commission on confirmed bookings, as communicated to the Host at the time of listing. Fees are non-refundable except where required by law or expressly stated in these Terms.

Now Villa may change its fees prospectively. Changes will not affect bookings already confirmed at the time the change takes effect.

6. Cancellations, refunds and changes

Each listing specifies the cancellation policy that applies to a booking. Refunds to Guests and payouts to Hosts on cancellation are governed by that policy and by any applicable mandatory consumer-protection law.

Where a Host cancels a confirmed booking, the Guest is entitled to a full refund of amounts paid for that booking. Repeated or last-minute Host cancellations may lead to penalties or removal from the Platform.

Now Villa may, in limited circumstances (such as force majeure, safety concerns or violations of these Terms), cancel a booking and issue refunds in accordance with our policies and applicable law.

7. Host obligations

Hosts are responsible for ensuring that they have the right to list and rent out the accommodation and that doing so complies with all applicable laws, regulations, tax obligations, condominium rules, mortgage or lease terms, and any registration, licensing or guest-reporting requirements (including, in Italy, guest reporting to the Polizia di Stato where applicable).

Hosts must keep listings accurate and up to date, maintain the accommodation in a safe and habitable condition, and respond to Guests and booking requests in a timely manner. Hosts are responsible for collecting and remitting any taxes they are legally required to collect.

8. Guest obligations

Guests must treat the accommodation and its contents with care, comply with the Host’s house rules and check-in/check-out times, and leave the accommodation in the condition in which it was found (subject to reasonable wear and use).

Guests are responsible for their own conduct and that of anyone they invite to the accommodation, and may be held liable by the Host for damage caused during a stay.

9. Reviews and user content

The Platform may allow Hosts and Guests to submit reviews, ratings, photos and other content. You are responsible for the content you submit and must ensure it is accurate, lawful and does not infringe the rights of others.

By submitting content you grant Now Villa a non-exclusive, worldwide, royalty-free licence to use, host, display and reproduce that content for the purpose of operating and promoting the Platform. We may remove content that breaches these Terms or applicable law.

10. Prohibited conduct

You agree not to use the Platform for any unlawful or fraudulent purpose; not to circumvent the Platform to arrange or pay for bookings off-Platform in order to avoid fees; not to post false, misleading or infringing content; not to harass, discriminate against or harm other users; and not to interfere with, scrape or attempt to gain unauthorised access to the Platform or its systems.

11. Intellectual property

The Platform, including its software, design, trademarks, logos and content (other than user content), is owned by or licensed to Week Homes S.r.l. and protected by intellectual-property laws. Except as expressly permitted, you may not copy, modify, distribute or create derivative works from any part of the Platform.

12. Liability

Because Now Villa acts only as an intermediary, we are not responsible for the acts or omissions of Hosts or Guests, for the condition, safety or legality of any accommodation, or for the performance of the accommodation contract between Host and Guest.

To the fullest extent permitted by law, Now Villa’s aggregate liability arising out of or in connection with your use of the Platform is limited to the total fees paid by or to you through the Platform in the twelve months preceding the event giving rise to the liability. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by our negligence, or for fraud. These limitations do not affect the mandatory rights of consumers.

13. Indemnity

You agree to indemnify and hold harmless Week Homes S.r.l. from any claims, damages, losses and reasonable expenses arising out of your breach of these Terms, your misuse of the Platform, or your violation of any law or the rights of a third party.

14. Suspension and termination

You may stop using the Platform and close your account at any time. We may suspend or terminate your access where you breach these Terms, where required by law, or to protect the Platform and its users. Provisions that by their nature should survive termination (including fees due, liability and governing law) will continue to apply.

15. Changes to these Terms

We may update these Terms from time to time. Where changes are material we will provide reasonable notice, for example by email or through the Platform. Your continued use of the Platform after the changes take effect constitutes acceptance of the updated Terms.

16. Governing law and jurisdiction

These Terms are governed by Italian law. Any dispute relating to these Terms or the Platform is subject to the exclusive jurisdiction of the courts of Lucca, Italy, save where mandatory law grants a consumer the right to bring proceedings before, or requires them to be brought before, the courts of the consumer’s place of residence.
